MOUNTAIN VIEW ADVENTURES, its owners, officers, employees, agents, representatives, parents, and affiliates have agreed to permit me to operate a snowmobile/side by side. In consideration for MVA and permission to operate the snowmobile, I promise and agree: 1. Full day is considered 8:00 am to 4:00 pm within the same day. A half day is considered 8:00 am to 12:00 pm or 12:00 pm to 4:00 pm within the same day. There will be $100 per hour late fee starting at 4:30 pm! Half day rentals late fees start after 4 hours slot is up. {Getting lost is not acceptable excuse} 2. To return the unit in the same condition as when taken out, fill with gas, except for normal wear or prior damage as listed. 3. To pay for any and all damages incurred to the unit, while I am using it. Including loss keys, ball joints, rims, tires and everything between the front and rear bumper no matter the circumstance, while I am using it. If damage to the unit makes it un-rentable for the following day you will be charged up to 3 full days of rental to cover loss of use until fixed. 4. To wear protective equipment, including but not limited to a helmet, face shield, etc. while operating the unit and further agree that any passenger will do the same. No passengers on snow bikes. 5. That neither Mountain View Adventures, nor any agent, employee, or related party of theirs is liable for damage to property of others or for injury to me or to others while the unit is/are in my care. 6. To operate a unit is AT YOUR OWN RISK (this includes operating on ice, lakes, ponds, rivers, paved roads, etc.). 7. Not to operate a unit under the influence of alcohol or drugs. 8. To ride only on marked, groomed trails. Unless backcountry riding snow bikes. 9. I take full responsibility for the health and well being of all passengers when renting this unit and release MVA for any injuries caused to me or my passengers. 10. I am aware that snowmobiling/snow biking, involves many inherent risks, dangers, and hazards, including but not limited to: exposed rock, earth, ice or other natural objects; trees, tree wells, tree stumps, forest deadfall; holes and depressions on or beneath the snow surface; variable and difficult snow conditions; changes or variations in the terrain which may create blind spots or areas of reduced visibility; streams, creeks, and holes in the snowpack above stream or creeks; winter travel on back-country roads; road-banks and cut-banks; impact or collision with other snowmobiles, side by sides and vehicles, becoming lost or separated from the guides or other participants; mechanical failure of snowmobiles and related equipment; extreme and rapidly changing weather conditions; encounter with wildlife including moose; the failure to operate a snowmobile/side by side, safely or within one’s own ability; negligence of other snowmobilers and other persons; and negligence on the part of Mountain View Adventures, or Rangeley Powersports including the failure by the Mountain View Adventures/Rangeley Powersports to safeguard or protect me from the risks, dangers, and hazards referred to above. Communication while snowmobiling/side by side in the terrain may be difficult, and in the event of an accident, rescue, medical treatment, and evacuation may not be available or may be delayed. 11. TO WAIVE FOREVER ANY AND ALL CLAIMS THAT I HAVE OR MAY HAVE IN THE FUTURE AGAINST MOUNTAIN VIEW ADVENTURES AND ANY AGENT, EMPLOYEE, OR RELATED PARTY OF MOUNTAIN VIEW ADVENTURES AND TO RELEASE THE MOUNTAIN VIEW ADVENTURES FROM ANY AND ALL LIABILITY for any loss, damage, expense, or injury, including death, that I may suffer or that my next of kin may suffer, as a result of my participation in snowmobiling/side by side, due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care, including any duty of care owed under the occupiers liability act, on the part of the Mountain View Adventures or, and further including the failure on the part of the Mountain View Adventures to safeguard or protect me from the risks, dangers and hazards of participating in snowmobiling/side by sides such as those referred to above. 12. By entering into this Agreement, I am not relying on any oral or written representation or statement made by Mountain View Adventures, other than what is set forth in this Agreement. This release shall be binding to the fullest extent permitted under Maine law. If any provision of this release is found to be unenforceable, the remaining terms shall be enforceable. I have read this agreement, and fully understand its terms and understand that I have given up legal rights by signing it, and I am signing it freely and voluntarily without any inducement. 13. That Mountain View Adventures and shall be entitled to collect all their expenses incurred in enforcing or collecting this Agreement, including but not limited to attorneys’ fees, paralegal and abstractor fees, and costs of suit. 14. A damage deposit is required in the form of a VISA, Amex or MasterCard preauthorization for each unit, until it is returned and checked for damage. The damage deposit does not include any type of medical, personal liability, or property damage coverage and it is understood that the renter is responsible for the entire cost of a replacement unit of the same year, make, and model if the machine is damaged beyond repair while in my use or possession. I understand that this could be up to $ 15,000.00 unit. 15. In case of a breakdown or emergency call 207-305-5233 and speak with an employee. Do not leave a unit unattended at any time, do not tow another unit or let others tow you. Additional time will be allocated for time lost due to breakdown for riders of down units only. 16. There are no refunds for early returns and no refunds due to weather. MVA personnel have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant's fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction. 17. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. I agree to wear a properly fitted and secured DOT or SNELL certified helmet while participating in this activity. 18. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless MVA from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of MVA equipment or facilities, including any such claims which allege negligent acts or omissions of MVA. 19. Should MVA or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs. 20. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have. 21. In the event that I file a lawsuit against MVA I agree to do so solely in the state of Maine, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect. By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against MVA on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at MVA. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms. By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against MVA on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at MVA. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms. Please keep in mind your signature will count for all three forms. But you will only sign on the third form.

20. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.
21. In the event that I file a lawsuit against MVA I agree to do so solely in the state of Maine, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. If an individual under the age of eighteen (18) years old seeks to use a snowmobile or side by side in connection with the services provided by Mountain View Adventures, Rangeley Powersports then that individual’s parent, guardian, or custodian must sign the following:
In consideration for the above-named minor being permitted by Mountain View Adventures and Rangeley Powersports to participate in the activity of snowmobiling or or side by sides which includes, without limitation, the use of its services and equipment, I agree to the following waiver, release, and indemnification:
The undersigned parent, or guardian, or custodian of the above-named minor, for himself/herself and on behalf of said minor hereby joins in the foregoing agreement and hereby stipulates and agrees to save and hold harmless, indemnify, and forever defend Mountain View Adventures, and Rangeley Powersports its directors, officers, agents, employees, and volunteers from and against any and all claims, actions, and causes of action, liabilities, suits, expenses (including reasonable attorney’s fees) and, NEGLIGENCE made or brought by said minor or by anyone on behalf of said minor, as a result of minor’s participation in the activity of snowmobiling or side by side and his/her use of the property, services, or equipment of Mountain View Adventures/Rangeley Powersports. I, for myself and on behalf of said minor further agree not to sue Mountain View Adventures/Rangeley Powersports as a result of any injury, paralysis, or death that said minor may suffer in connection with his/her participation in the activity of snowmobiling.
I will stay on the marked trail! If I roll or crash a unit I understand that I will be charged a damage fee of $2000.
1. This fee covers days the unit is down and can’t be rented.
2. Recovery to come get the unit.
3. Full damage report from dealer.
4. Oil & filter change - New air filter - New spark plugs, complete service.
5. Dealer safety check on the unit before it’s put back in the lineup.
This fee is separate from the cost to repair the unit! This will be added to the parts and labor estimate from the dealer
